1.     Introduction

This document sets out the terms and conditions (the “Terms”) for the “Thin Lizzy Loves Rugby” cashback offer (the “Cashback Offer”). 

The promoter is Brand Developers Aust Pty Ltd (ACN 115 139 56), Warehouse A, 9 Kimpton Way, Altona VIC 3018  (the “Promoter”).

 

2.     Offer Period

00:00 AEST on 12^th Sep 2023 to 23:59 AEST on 18^th Sep 2023.

 

3.     Entry Requirements

The offer is open to individuals who:

a)    Are residents of Australia;

b)    Are at least 18 years of age; and

c)     Make any purchase on any products on https://thinlizzy.com.au/during the Offer Period,

each an “Entrant”. 

 

Any Entrant who places an order during the Offer Period will automatically be entered.  Entrants may place several orders during the Offer Period.  Each order placed by an Entrant shall be bound by the website terms and conditions https://thinlizzy.com.au/pages/terms-conditions.In the event of any inconsistency between those terms and these Terms, these Terms shall prevail.  Where all goods within a qualifying order are returned under the 30 day “Risk-Free Trial Period”, the Entrant shall be automatically excluded from this Cashback Offer.

 

Once the Offer Period is over, no further entries will be accepted.  Orders placed prior to the beginning or after the end of the Offer Period will not be entered into the offer and no correspondence will be entered into with regards to eligibility.  By placing an order during the Offer Period, all Entrants acknowledge that these Terms shall apply. 

 

4.     The Cashback Offer

In the event that the Australian National Team wins the 2023 Rugby Tournament on 29 October 2023(AEST), all Entrants shall be automatically provided with a full and automated refund of twice the full purchase price (ie 200% of the full purchase price) of their order (up to a maximum of $1000 total order value), via Paypal. No refunds will be given for the processing and handling fee (‘P&H’) (P&H includes postage, delivery and other logistics services). Each Entrant agrees to only be paid through PayPal. Each Entrant must have or create a PayPal account and will be required to communicate their PayPal email address to the Promoter via asign-up link when ordering on https://thinlizzy.com.au/. There fund will be processed within 30 days of the tournament closing ceremony.

 

In the event that a refund cannot be processed, the Promoter will attempt to contact the Entrant in order to process the refund. If contact cannot be made, the Entrant waives their right to the Cashback Offer.

 

5.     General

The Cashback Offer is valid in conjunction with any other advertised offers, promotions or discounts available on the website during the Offer Period (for example, buy one get one free offers) but shall not be valid with any discount codes. 

 

These Terms are to be construed in accordance and enforced in accordance with the laws of New South Wales, Australia.  Any dispute arising from this Cashback Offer is exclusively subject to the jurisdiction of the courts of New South Wales.

In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error or other circumstance outside the Promoter’s control affects or could affect the proper operation of this Cashback Offer, the Promoter reserves the right to cancel or amend the Cashback Offer or these Term sat any stage, but will always endeavour to minimise the effect to Entrants in order to avoid undue disappointment.

 

The Promoter reserves the right to exclude any entries and cancel related orders that it reasonably believes to be fraudulent or based on misconduct or where there are reasonable grounds to believe there has been a breach of these Terms. This includes where the Promoter believes that the products purchased are intended for resale.  The Promoter will be the final arbiter in any decisions, and these will be binding and no correspondence will be entered into in relation this clause.

 

The Promoter is not responsible for any problems or technical malfunction of any computer on-line systems, communication network, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise, injury or damage to entries or to Entrants’ or any other person's computer related to or resulting from participation in the Cashback Offer. Except for any liability that cannot be excluded by law, the Promoter(including its officers, employees and agents) excludes all liability for any personal injury; or any loss or damage; whether direct, indirect, special or consequential, arising in any way out of the Cashback Offer.
